thepenpointproject.org (the "Platform," "we," "us," "our") is operated by Pen Point Project Co. ("Pen Point," the "Organization"), a nonprofit organization incorporated in the State of Georgia. The Platform provides project-based, mentorship-driven music education programs, including live video mentorship sessions, to students, with a primary focus on youth under age 19.
By accessing or using the Platform, you agree to these Terms of Service ("Terms"). If you are under 18, a parent or legal guardian must review and accept these Terms on your behalf, and must also complete our separate Minor Enrollment Agreement and Parental Consent Form before you may participate.
The Platform provides music mentorship and education services, including live video sessions. The Platform does not process payments directly; it hosts links to payment pages on the official nonprofit website.
The Platform is an educational and mentorship service. It is not a substitute for professional mental health services, medical care, or licensed therapy, and mentors are not acting in a therapeutic or clinical capacity.
All sessions between a coach and a minor student may be recorded for safety, quality assurance, and dispute-resolution purposes if requested by parents or admin. Recordings are retained for 120 days and are accessible only to coaches, mentors, admin staff, and parents.
Coaches and students/guardians agree to conduct all communication exclusively through Platform-approved channels. Off-platform contact (personal phone numbers, social media, personal email) between a coach and a minor student is strictly prohibited, except as explicitly authorized in writing by a parent/guardian and the Organization.
Any coach or student who becomes aware of a safety concern, inappropriate conduct, or suspected abuse must report it immediately in accordance with our Child Safety and Safeguarding Policy.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Parents and guardians are responsible for supervising a minor's use of login credentials.
If you provide a mobile number and give express written consent, Pen Point Project Co. will send you text message reminders about scheduled mentorship sessions and enrollment calls, and requests to confirm attendance. These messages are transactional. We do not send marketing, promotional or fundraising text messages.
You must be 18 years of age or older to use this SMS service. For students under 18, the parent or legal guardian provides consent and is the sole recipient of all text messages. Pen Point Project Co. does not send text messages to anyone under 18.
Messages are sent from (478) 245-4777. The consent checkbox reads "Yes, text me reminders about my sessions from Pen Point Project Co." and is never pre-checked. It is published in full at https://thepenpointproject.org/legal/sms-consent.html
Consent is not a condition of enrollment, of purchase, or of any service.
You can cancel at any time by replying STOP to any message. STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT are also honoured. We will send one confirmation message, after which you will receive no further messages.
Reply HELP or INFO to any message for assistance, or email support@thepenpointproject.org.
Message frequency varies. Message and data rates may apply.
Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent will not be shared with any third parties.
Our full messaging program terms are set out in our Privacy Policy at https://thepenpointproject.org/legal/privacy.html
All users must comply with our Code of Conduct and Community Guidelines, incorporated by reference into these Terms. Violations may result in suspension or termination of access, at the Organization's sole discretion, with immediate termination for any conduct that raises child-safety concerns.
Platform content (curriculum materials, branding, site design) is owned by Pen Point Project Co. and may not be reproduced without permission.
Student work (recordings, compositions, portfolio materials created by a student) remains the property of the student, or their guardian if a minor, subject to any limited license granted to the Platform under Section 9.
Coach-created materials (lesson plans, curriculum) are addressed in the separate Coach Agreement.
We will not use a student's image, name, video, or work product for marketing, promotional, or public-facing purposes without separate, explicit, opt-in written consent from the student (if 18+) or parent/guardian (if a minor). This consent is not required to participate in the Platform and may be withdrawn at any time by contacting permissions@thepenpointproject.org.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE ANY SPECIFIC EDUCATIONAL, ARTISTIC, OR CAREER OUTCOME.
TO THE FULLEST EXTENT PERMITTED BY LAW, PEN POINT PROJECT CO. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE PLATFORM.
We may suspend or terminate any account at our discretion, including immediately and without notice where necessary to protect the safety of a minor or other user.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
We may update these Terms from time to time. Material changes will be communicated on this page at least 10 days before taking effect.
